GENERAL SALES CONDITIONS

All the products purchased through www.enotecapirovano.com are sold directly by Enoteca Pirovano of PIROVANO FLAVIO & C. S.N.C., registered office in Italy, Via Dante, 21, Zip code 23884, Castello di Brianza (Lecco), registry of businesses, tax code and VAT number 01382160131.

The general terms of sale (sales conditions) for the purchase of wines and spirits through the website www.enotecapirovano.com, are included in the sales agreement. Each user is obliged to review the sales agreement itself before placing a purchase order. Sending an order means that the user fully accepts the sales agreement in each point.

Enoteca Pirovano will have the right to modify or simply update, wholly or partially, these general terms of sale and they will be binding for the user once published on the website, in this same section of the previous replaced ones.

1.Customers

Order placements on www.enotecapirovano.com are only allowed to users who have the legal ability to enter into binding agreements, in accordance with the applicable law. The order placement represents an act for purposes, unrelated to any business or professional activity.
The sale of alcohol to users who have not came of age is forbidden. By placing an order through www.enotecapirovano.com , the customer ensures that the ordering entity and the product users are both 18 years old. The buyer who is not an Italian citizen can purchase products on the website www.enotecapirovano.com only  if he/she is in compliance with his/her national law related to the previous sentence. If there is no legislation in this regard, he/she must be at least 21 years old. In any case, the user who purchases through www.enotecapirovano.com is fully responsible for the action and agrees to exclude Enoteca Pirovano from any liability in the event that he/she has purchased on the site without complying with his/her national law regarding age limits.
Customers will need to register on www.enotecapirovano.com and to provide their personal data to place an order. The word “personal data” includes: first name, last name, date of birth, email address, product delivery address, tax code and other details required at the purchase order placement time. All the data must be true and constantly updated. We suggest the customer to analyse the privacy policy to find out how and what he/she is going to do about the processing of personal data by Enoteca Pirovano and about how the data will be handled.
The customer is not allowed to place orders on www.enotecapirovano.com  using the personal data and/or credentials of another user, unless this action has been expressly authorized by the same one. In this regard, we suggest you to have a look at our terms of use.
Above all, it is strictly forbidden to purchase products for re-sale purposes.

2.Prices

All the products prices on www.enotecapirovano.it are expressed in Euro Currency (€) and they already include the Added Value Tax ("VAT").
The price of each product can be changed by Enoteca Pirovano any time, without notice. It is clear that the price for an already purchased item by the user, will be the one agreed at the time of the order sending. Any change in the product price (increasing one or decreasing one) following the order placement will not be considered.
The amount of shipping charges (if required), already including VAT, will be displayed in the order summary during the checkout process and it will be reported in the order confirmation sent to the customer, following the order acceptance.

3. Payment Methods

All the payments related to purchase orders placed on www.enotecapirovano.com website are absolutely safe and lawful. Each customer can choose to pay for an order in several different ways, as here below indicated and explained:

STRIPE-CREDIT CARDS

Credit card payments on the website are handled by the system called Stripe. They do not involve any kind of commission and they are absolutely safe. Each customer can pay with all Visa credit cards (including PostePay) and Mastercard.
If a payment fails, the user can access his/her order in the account and change the payment method or try/repeat it again.

PAYPAL

By paying through PayPal, after the order is confirmed, the customer will be redirected to the Paypal website for payment.

BANK TRANSFER

If the customer pays using a bank transfer, Enoteca Pirovano will ship the purchase order as soon as the payment will be cashed in officially and after the confirmation receipt shared by our bank. Here below you can find all the details to be included in the bank transfer:

It is extremely important to indicate the full and complete purchase order number in the bank transfer itself, otherwise payment could not be correctly processed and, as a consequence, received by Enoteca Pirovano.

In the event of an error, mistake, negligence or wrongdoing from the Payment Gateway and/or from the brokerage systems in payments, related to the transaction handling of a specific order, the seller will not be liable for such error, mistake, negligence or wrongdoing.

4. Accepting an order - Sales agreement

To complete the purchase order for one or more products on the website www.enotecapirovano.com, the user will have to fill in an electronic order form and to send it to Enoteca Pirovano, following the instructions that will appear from time to time on the website. They will be displayed during the purchase stages and the customer will have to accept them in the check box section.
Once the order form has been filled in, Enoteca Pirovano will send to the user by email the order confirmation containing the details related to the purchase order itself.
Sending an order involves the customer's clear acceptance of the obligation to pay the indicated price.
This communication has the aim to inform the customer that the order has been received and to provide him/her with the order identification code. It does not in any way imply the acceptance of the order by the seller.
The order form will be stored in the database for the time it will take to fulfil the order itself, in accordance with the law terms. The customer can access the order form through the personal account.
If one (or more) of the reported data is not correct, the user must notify it to our customer service at the following email address: vendite@enotecapirovano.com . The order acceptance by Enoteca Pirovano will take place only when we will send to the customer our order confirmation, as a rule at the same time of the product shipment.
Before that, Enoteca Pirovano reserves the right not to accept an order if it is considered inappropriate. In particular, Enoteca Pirovano will not be responsible, for any reason, in case a purchased product will be removed from the website after sending the relevant order.
As a matter of fact, it may happen that the website displays by mistake products not available at that moment.

5. Products availability

Products displayed on the website are limited as concerns the quantity. It may happen that multiple users will purchase the same product at the same time or that the ordered product is no longer available after the purchase order is officially transmitted.
In the case of a partial unavailability of the order, the customer will be promptly informed by Enoteca Pirovano to verify the latter's willingness to receive a partial order, or to cancel it.
In the case of a total order unavailability, Enoteca Pirovano will contact the customer to inform him/her that the order cannot be processed and that it will be deleted.
The customer will be, as per agreement, then refunded no later than 15 working days from the date of payment. The refund will include the purchased product cost, including shipping charges (if required). This amount will be sent back through the same payment means used by the user to place the purchase order or through different ways, obviously agreed between the user and Enoteca Pirovano. Delays in refunding the customer may depend on his/her bank, credit card type, or payment mean.

6. Shipments and deliveries of purchased products

Enoteca Pirovano accepts orders with delivery all over Italy and abroad, shipped using the express courier.
In each country, to protect our customers, shipments are always ensured against breakage, theft or loss.
Each shipment is processed using certified packaging, designed specifically to protect the most fragile products.
Enoteca Pirovano is committed to accurately and quickly send orders to customers, in accordance with the delivery deadlines indicated on the website during the purchase order process.
The timing will be 24/48 working hours throughout Italy except Islands, where the delivery time could be slightly longer and, in any case, within 30 days from the date of the order confirmation sending to the customer. As for foreign countries, the delivery time will be 4/5 working days, to be calculated from the above-mentioned period.
Enoteca Pirovano will also be free of liability for delays due to force majeure, strikes, natural disasters/diseases and any other fact related to the provision of courier services or to any other circumstance beyond its control.
The order confirmation shows the tracking number by which the customer can monitor the shipping process and the delivery on the courier's website.
The courier will make a first attempt to deliver the order to the address indicated by the customer. If the delivery fails, the courier will inform the customer of the successful delivery attempt and will try to agree with the customer a further order.
In the event that the courier is not able to deliver the order permanently, the customer service will contact the customer to verify his/her interest in a new shipment.
The amount of delivery charges owed by the user in relation to a specific order is expressly and separately indicated (in Euro and including VAT) during the purchase process, in the summary of the order and, in any case, before the user proceeds to transmit and confirm the same one.
Orders for non-EU countries may be subject to customs fees and/or other additional charges, so Enoteca Pirovano refrains from incurring into these costs, which will be solely borne by the customer and will be only at his/her charge.

The delivery obligation is fulfilled by transferring the purchased material or, in any case, the control and handling of the product to the user.

It is up to the customer to verify the condition of the product that has been delivered to him/her and/or that he/she has collected. The risk of loss or damage of products, due to non-attributable to Enoteca Pirovano, is transferred to the user when he/she, or a third party from the same designated and other than the carrier, enters materially in the possession of the purchased product. As a consequence, it is recommended to the user to check the received product and that the packaging is not damaged, nor wet or otherwise altered. It is suggested to the customer to indicate on the carrier's transport document any anomalies, accepting the package reserving his/her right to complain for a reason (e.g. wet package, damaged package, etc).

The product receipt without any claim indicated, will not allow the user to take further legal actions against the courier and/or against Enoteca Pirovano in the case of products loss or damage, except for two reasons: if they are related to the courier's gross negligence and if they represent a partial loss or damage not recognizable at the time of delivery, provided in the latter case, the damage is promptly reported. In case there are clear and obvious evidences or damages and/or tampering on the packing, it is also recommended that the user gives a prompt and immediate notice of it to our customer service,  at the following e-mail address vendite@enotecapirovano.com, also attaching a photo of the damage itself.
